1. About Cloudwindz

Cloudwindz is a reputation management and review automation service operated by Total Web Solutions (Registration No: 202303156196 / RA0101133-T). Cloudwindz acts as the service provider and primary point of contact for users.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into a binding agreement to use our Services.

3. Account Registration

  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to provide accurate and complete information
  • You are responsible for all activities under your account

4. Subscription, Billing & Payments

  • Services may be offered on a subscription basis
  • Fees are billed in advance and are non‑refundable, unless stated otherwise
  • Failure to complete payment may result in service suspension or termination

Cloudwindz reserves the right to change pricing with reasonable prior notice.

5. Acceptable Use

You agree not to:

  • Use the Services for unlawful, misleading, or abusive activities
  • Send spam or unauthorized review requests
  • Manipulate or falsify customer reviews
  • Attempt to reverse engineer or resell the platform without authorization

6. Third‑Party Platforms & Reviews

Cloudwindz integrates with third‑party platforms (e.g., Google Business Profile). We do not control third‑party policies, review moderation, or listing removals.

Cloudwindz does not guarantee review outcomes, ratings, or ranking improvements.

7. Intellectual Property

All content, software, branding, and trademarks used in Cloudwindz are owned by or licensed to Cloudwindz and its technology partners.

You may not copy, distribute, or modify any part of the Services without written consent.

8. Data Ownership

  • You retain ownership of your business data and customer information
  • You grant Cloudwindz a limited license to process such data solely for service delivery

9. Service Availability

  • Services are provided on an “as‑is” and “as‑available” basis
  • We do not guarantee uninterrupted or error‑free operation

10. Limitation of Liability

To the fullest extent permitted by law:

  • Cloudwindz shall not be liable for indirect, incidental, or consequential damages
  • Total liability shall not exceed the amount paid by you in the preceding 3 months

11. Indemnification

You agree to indemnify and hold Cloudwindz harmless from claims arising from:

  • Your misuse of the Services
  • Violation of these Terms
  • Breach of applicable laws or third‑party rights

12. Termination

We may suspend or terminate your access if:

  • You breach these Terms
  • Required by law or platform providers
  • Non‑payment or abusive behavior occurs

Upon termination, access to the Services will cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, unless otherwise stated.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the revised Terms.
